SC pool builder sued for breach of contract

More than 30 people have filed a lawsuit against Indigo Pools LLC, a fiberglass pool installer in Dorchester County, South Carolina.

The lawsuit accuses the company of breach of contract, fraud, and negligence, among additional allegations.

According to the lawsuit, Indigo Pools entered into contracts with at least 32 individuals and took substantial deposits to install swimming pools and then left clients with either no pool, a non-functioning pool, or a pool that was not in accordance with what was agreed upon.

The suit alleges the company breached its contract with customers by failing to complete jobs, install pools correctly or fix problems and not returning customer money when it didn’t uphold its contract.

Thursday Pools, doing business as River Pools and Fiberglass Pools, as well as its owner, Jason Hughes, are also named as defendants for helping facilitate Indigo Pools’ “fraudulent pool scheme.”

Indigo Pools, located in Summerville, is owned by husband and wife Josh and Ashley Ingram, who were each arrested in Dorchester County in December 2023 and charged with breach of trust with fraudulent intent of more than $10,000.

The couple had declared bankruptcy in September 2023, but numerous civil and criminal charges have continued to be filed against them.

Their latest civil charge was brought by 32 disgruntled customers in May at the Dorchester County Court of Common Pleas and demands a jury trial for damages and interest, including attorney fees.
