The Pool and Hot Tub Alliance, PHTA, has launched a resource page offering guidance for small business owners on how to respond to Immigration and Customs Enforcement (ICE), workplace inspections.
“With reported incidents in our own industry, it is crucial for employers and employees to know their rights, understand the differences in types of warrants, and proactively prepare for possible audits or raids,” PHTA states on its webpage.
According to PHTA, the webpage is designed to help employers in the following areas:
• Know their rights and responsibilities when ICE arrives.
• Understand the difference between judicial warrants (signed by a judge, legally enforceable for entry) and administrative warrants (issued by ICE, not sufficient to enter private areas).
• Prepare proactively with written policies, employee training, and legal counsel.
• Respond properly if ICE shows up at a workplace or job site, minimizing liability.
It also points members toward advocacy actions, like the PHTA templatelettertoCongress,topushback or voice concerns about immigration enforcement in the industry.
